A. FREE TIME AND DETENTION CHARGES FOR EQUIPMENT REMOVED
FOR LOADING AT CY - MAINLAND
1. Carrier reserves the right to expect that equipment
issued to Shippers for loading will be returned to
Carrier for movement via Carrier's vessel in an
expeditious and timely manner.
2. Except as otherwise provided, when equipment
(Containers or Chassis, or combinations thereof) is
removed from the CY for Westbound Loading as
authorized under Rule 849, the equipment must be
returned loaded to the CY in advance of the
Carrier's CY cargo receiving deadline for the
Carrier's voyage to which the shipment is booked.
3. If the total number of containers/equipment
returned loaded is less than the amount removed
empty under the booking, then Carrier at its
option will either (1) require in writing that the
unused equipment be returned to the CY or (2)
authorize Shipper in writing to hold the equipment
as part of the total required for a subsequent
booking.
4. When Carrier does not give specifically written
authorization for holding the equipment for a
subsequent sailing, and Shipper refuses or is
unable to return unused equipment to the CY,
Detention charges as shown below will be assessed
for each day, or fraction thereof, beyond the date
Carrier ordered the equipment returned. Detention
charges will end on the day the equipment is
returned to Carrier or Carrier's Agent:
Dry, Closed Container; Chassis; or Dry, Closed
Container on Chassis (Not applicable on Special
Equipment listed below..................$39.97
Insulated, Flatbed, Open-top, Refrigerated or
other Special Equipment, on Carrier's Chassis
or not on Carrier's Chassis.............$64.58
5. When Shipper utilizes an unauthorized carrier for
on-carriage to destination without written
permission from the Carrier, the the Carrier will
assess a fee as specified below for each piece of
equipment not so returned:
Dry, closed Container; Chassis; or Container on
Chassis (not applicable to Insulated, Flatbed,
Open-Top, Refrigerated or other Special Equip-
ment Containers)......................$1135.00
Insulated, Flatbed, Open Top, Refrigerated or
other Special Equipment Container; or
insulated, Flatbed, Open Top, Refrigerated or
other Special Equipment Container on
Chassis...............................$2288.00
Additionally, Detention Charges as Noted in 4
above are applicable.
B. EXCEPTIONS TO FREE TIME AND DETENTION PROVISIONS -
PACIFIC COAST
1. Containers or chassis owned or leased by Shipper
or Consignee are not subject to provisions of this
rule.
2. Containers or chassis owned by Rail, Water or
Motor Carriers are not subject to provisions of
Paragraph A. of this rule when interchanged to
Participating Carriers by the owning Carrier or a
Connecting Carrier thereof at direction of the
Shipper, and Participating Carriers have no
obligation with respect to such equipment prior
to its receipt.
3. Containers or chassis are not subject to
provisions of Paragraph (A) of this Rule when
interchanged to Participating Carriers by a rail,
water or Motor Carrier for direct through movement
to Hawaii from points located other than in the
states or provinces of British Columbia,
Washington, Oregon, Nevada or California under
provisions of an equipment interchange agreement
with the Connecting Carrier.
4. Containerloads of Household Goods are not subject
to provisions of Paragraph A of this Rule.
Household Goods fee time includes the day of
interchange plus 29 calendar days, inclusive of
weekends and holidays, for a total of 30 calendar
days. Household Goods free time of 30 days is only
applicable within the contiguous U.S.
C. FREE TIME FOR EQUIPMENT REMOVED FROM WEST COAST
TERMINALS FOR UNLOADING
1. Except as otherwise provided, when a container,
chassis, or combination thereof is removed from CY
for unloading, free time for unloading and return
to the CY shall be 48 hours beginning with the
first midnight following removal from CY except
that the hours of any Saturday, Sunday or Holiday
which occur within the initial 48 hour period will
not be counted.
2. In lieu of returning the equipment to the CY, the
Consignee may utilize the equipment for loading of
a Westbound shipment. In this case,
Consignee/Shipper is expected to return that
equipment to Carrier for movement by Carrier's
vessel in an expeditious and timely manner.
3. In lieu of returning the equipment to the CY,
Consignee or his agent may, upon notification to
and consent of Carrier, deliver the empty equipment
to another party for loading of a Westbound
shipment, and the responsibility of the Consignee
or his agent shall cease when the equipment is so
delivered and a clean receipt therefore is given
by the authorized receiving party. In this case,
the receiving party is expected to return that
equipment to Carrier for movement on Carrier's
vessel in an expeditious and timely manner.
4. EQUIPMENT DETENTION CHARGES
When equipment is returned to CY after expiration
of free time detention charges shall be assessed
as follows:
For each non-refrigerated
container per day or fraction thereof.......$40.00
For each refrigerated
container per day or fraction thereof.......$89.00
For each chassis removed without
a container mounted thereon or with
a container not subject to these
provisions per day or fraction thereof......$40.00
D. DEMURRAGE AND FREE TIME FOR INBOUND CONTAINERS AT WEST
COAST TERMINALS
1. Free time for shipments in containers at West
Coast Terminals (CY) will commence at 0800
on the first business day following completion
of vessel discharge, and shall be five (5) days,
not including Saturdays, Sundays or holidays.
As an exception, return loads of empty pallets and
dunnage shall have 15 calendar days free time
starting at 0800 on the first business day
following completion of vessel discharge. (C)
2. Cargo in containers remaining at CY after
expiration of free time shall be assessed storage
charges as follows for each day (24 hours or
fraction thereof) stored beyond the free time:

FOR LOADING AT CY - MAINLAND
1. Carrier reserves the right to expect that equipment
