A. Containers loaded by Shipper will be accepted same as
"Shipper's Load and Count" and the Bill of Lading shall
be so claused, and:
1. Carrier will not be directly or indirectly
responsible for damage resulting from (i) improper
loading or mixing of articles in containers, (ii)
Shipper's use of unsuitable or inadequate
protective and securing materials when loading
to open side flatrack type containers, or
(iii) for any discrepancy in count or concealed
damage to articles.
2. Carrier reserves the right to open containers,
inspect their contents and replace the container
seal. Carrier will, in such instances, indicate
on the bill of lading that such an inspection has
occurred and record the new seal number.
3. Shipments moving subject to this Rule which in the
opinion of the Carrier cannot be properly or
safely handled due to improper loading or weight
distribution without rehandling, shall not be
transported until satisfactory arrangements are
made with the Shipper or Consignee to remedy the
unsafe conditions.
