Shipments listed in paragraph (a) below which are being
returned to the original Shipper will be assessed charges
on
the basis of:
(1) For shipments returning to the mainland, 66.67% of the
base rate applied to the westbound shipment or the full
applicable eastbound rate, whichever is lower, subject to
the minimum bill of lading charge set forth in Rule 610
or:
(2) For shipments returning to Hawaii, 50% of the base rate
applied to the eastbound shipment or the full applicable
westbound rate, whichever is lower, subject to the minimum
bill of lading charge set forth in Rule 610.
If the lower charges result from application of 66.67% of
the westbound rate, or 50% of the eastbound rate, the
conditions set forth in paragraphs (b) through (e) below
must be met:
(a) Goods damaged in transit, or goods refused by the
Consignee, or goods which have been used in convention
exhibition displays
(b) The returning shipment must be supported by a copy of
the Carrier's bill of lading evidencing original
movement via container service.
(c) Shipments must be offered within 75 days of the date
shown on the bill of lading referred to in paragraph
(b) above.
(d) All charges must be prepaid or guaranteed.
(e) Provisions of this Rule apply to shipments returned on
a CY/CY basis only.
