A shipment may be diverted at the request of either Shipper
or Consignee, subject to the conditions and additional
charges, if applicable, as named below. Carrier will
endeavor to comply with request of Shipper or Consignee,
but is not obligated to do so if such compliance will
unduly interfere with operation of Carrier's vessel or
terminal.
A. DIVERSION WHILE THE SHIPMENT HAS NOT MOVED BEYOND
HONOLULU
1. A shipment originally consigned for delivery at a
port beyond Honolulu may be diverted for Honolulu
delivery, or for delivery to a different port
beyond Honolulu to which the rate applies.
2. A shipment originally consigned for Honolulu
delivery may also be diverted to another scheduled
Port of Discharge not within the scope of this
Tariff.
3. If diversion under (1) and (2) above can be
accomplished without rehandling of cargo, no charge
will be assessed. When diversion causes cargo to
be rehandled, a charge of $6.77 per 100 lbs. will
be assessed. (A)
B. DIVERSION AFTER THE SHIPMENT HAS MOVED BEYOND
HONOLULU:
A shipment consigned to CY at a port beyond
Honolulu may be diverted to a different Hawaii port
to which the rate applies, subject to a diversion
charge of $488.00, plus an additional charge of
$1877.00 per container less than 40 feet in length
or $2472.00 per container 40 feet in length or
greater. Diversion will not be accepted under this
paragraph for shipments in trailers. (A)
C. DIVERSION FROM CFS TO CY:
A charge of 59 cents per 100 lbs. shall be assessed
based on the total weight of the shipment so
diverted. (A)
D. DIVERSION FROM CY TO CFS:
A charge of 94 cents per 100 lbs. shall be assessed
based on the total weight of the shipment in
addition to all other applicable charges, subject
to a minimum charge of $20.31 per 100 lbs. (A)
E. Diversion orders should be received by Carrier
before the vessel arrives in Honolulu. If requests
are received thereafter, Carrier will diligently
endeavor to accomplish same, but will not be held
responsible if unable to make such diversion.
F. In addition to the charges described in other parts of
this Rule, all accrued storage and other lawful
charges must be paid before shipment will be released
by Carrier to the Consignee.
