Except as otherwise provided in individual commodity
items,
A. The rates named in this Tariff apply in closed Dry
(Non-Refrigerated) Containers having an overall length
of 20 feet, 40 feet, or 45 feet, an overall width of
eight feet and an overall height of eight feet, six
inches or 9 feet 6 inches, open sided flatrack
containers having an overall length of 40 feet (See D.
below), or (for shipments of refrigerated cargo)
refrigerated containers having an overall length of 40
feet and a cubic capacity of not less than 1,046 cubic
feet.
B. The specifications of containers furnished under
provisions of this Tariff are published in the Official
Intermodal Equipment Register, ICC OIER 6039-D or
reissues thereof.
C. Notwithstanding the weight capacities shown in the
governing publication, actual load limits will vary
according to the laws of the jurisdictions through
which the equipment is operated, the type of tractor
used to pull the container and other factors. All
containers are marked with weight capacities in
accordance with regulations of the Occupational Health
and Safety Administration, and no container will be
accepted at CY if loaded with a weight which exceeds
the marked weight capacity shown thereon. If a
container is tendered for CY service with contents in
excess of the allowable weight, the Shipper or Agent
shall remove the excess weight; or where CFS service
is available. Shipper or Agent may exercise the
option of engaging Carrier to perform this service.
If Carrier removes the excess weight for Shipper or
Agent, transfer charges shall be for account of the
Shipper or Agent and the excess weight will be
reloaded to another container for carriage, subject to
applicable freight charges as if tendered to carrier
at CFS.
D. Cargo will be accepted on flatrack (FR) containers, but
oversize cargo must have prior approval by the
Carrier. Except as otherwise specified, rates
for cargo on flats apply only when cargo and dunn-
age/supporting materials do not exceed the dimensions
of the flat. These dimensions are:
40B FR: 38'11"x7'10"x7'7"(LWH)
45' FR: 44'5" x7'10"x7'7"(LWH)
