1. AND or OR
The words "And" and "Or" are used interchangeably, and
are convertible by the substitution of one for the
other, as the sense may suggest or require.
2. CARRIER
Carrier means Pasha Hawaii Holdings, LLC or any other
participating Carrier.
3. CHARGE
The dollars and cents result of applying a rate
against a stated unit, before deducting or crediting
allowance, if any.
4. CHASSIS
Chassis means a wheeled frame designed to carry
demountable containers.
5. CONTAINER
A unit, not less than 20 feet overall in length,
designed for the intermodal transport of cargo,
constructed to permit lifting on and off Carrier's
vessels and requiring mounting to a chassis for
movement over streets and highways. For the purpose
of applying rates and rules in this Tariff, the word
"Container" or "Carrier's Container" shall also mean
"Trailer" except where a distinction is clearly made
between the terms in rates or rules.
6. CONTAINER FREIGHT STATION (CFS)
The place where goods are received by Mainland
Participating Carriers for loading into containers and
where such goods are unloaded by Carrier from container
for delivery in Hawaii.
7. CONTAINER YARD (CY)
The place where loaded containers are received by
mainland Participating Carriers and where loaded
containers are delivered by Carrier in Hawaii.
8. CONTAINER FREIGHT
Except where otherwise specifically provided in a rule
or individual rate item of this Tariff, the term
"Container Freight" is defined as freight, no single
piece or package of which exceeds the following
dimensions:
A. For freight tendered at CFS or in a closed
container at CY: 39 Feet 5 Inches in length, 7
Feet 6 Inches in width, or 7 Feet 5 Inches in
height.
B. For freight tendered on a Flatrack Container at CY:
39 Feet 6 inches in length, 7 Feet 10 inches in
width, and 6 feet 6 inches in height. (See also
Rule 780)
9. CONTAINERLOAD OR LESS-THAN-CONTAINERLOAD
(1) Containerload (CL) means a shipment moving under a
rate subject to a flat charge per container. (2)
Less-than-containerload (LCL) means a shipment moving
under a rate other than as specified in (1) above.
10. FLAT OR FIXED CHARGE PER CONTAINER
A rate which results in both a minimum and maximum
charge per container for the carriage of goods
described in an item naming such charges.
11. HOLIDAYS
Holidays means the day on which New Years Day;
Presidents Day; Memorial Day; Independence Day; Labor
Day; Veterans Day; Thanksgiving Day and Christmas Day
is officialy observed. Within California, Admission
Day is also a Holiday. Within Hawaii, the day on
which Kamehameha Day, Discoverer's Day, Harry Bridges
Day, and Jack Hall Day are officially observed shall
also be Holidays.
The term "Holiday" shall also mean any other full day
designed by statute or by proclamation as a National
Holiday and shall also include such days designated
as "holidays" by application of collective bargaining
agreements.
For commodity rates subject to a weekly volume
requirement, the eve of the Thanksgiving, Christmas and
New Years holiday and the holiday day will reduce
weekly volume requirement by 20%.
The overflow rate in weekly volume requirement rates
does not apply when the weekly volume requirement
applied is reduced due to a Holiday. (C)
12. HHGDS
Means Household Goods and Personal Effects
13. INTERMODAL OCEAN FREIGHT
Intermodal Ocean Freight means rates to/from named
points in the contiguous USA (except California and
Arizona) transported using a combination of rail and
motor vehicle. See Rule 160: Application of Rates,
section (A)(3).
14. JOINT THROUGH RATE
Means the rate from a specific point within a zone via
given route to destination CY, determined by adding
the base rate or charge to a zone arbitrary.
15. LOADING OR UNLOADING
Loading or Unloading means the physical placing of
goods into or physical removal of goods from
containers.
16. MINIMUM WEIGHT
As used in rate items means weight in pounds.
17. MINIMUM CONTAINERLOAD WEIGHT
Except as provided in Rules 645 and 882, the highest
weight published in a rate item shall be the minimum
containerload weight for all articles described in the
item.
18. MIXED SHIPMENT
A shipment consisting of articles described in and
rated under two or more rate items in this Tariff.
19. ONE COMMODITY
Any or all of the articles described in any one rate
item in this Tariff.
20. POINT OF ORIGIN
Means the precise location at which goods are
physically received by Carrier for transportation.
21. POINT OF DESTINATION
Means the precise location at which goods are
delivered in accordance with the Bill of Lading.
22. PORT OR MOTOR OCEAN FREIGHT
Port or Motor Ocean Freight means rates to/from
Carrier’s Terminals in California (see Rule 940),
to/from named points in California or Arizona
transported via motor vehicle, and to/from named
points in the contiguous USA when specifically noted
as “all motor routing”. See Rule 160: Application of
Rates, section (A)(1) and (A)(3).
23. RAIL RAMP (R)
Inland Rail terminal where loaded containers are
received for delivery by rail to Carrier's West Coast
ports and where loaded containers are received after
delivery by rail from Carrier's West Coast ports.
NOTE: Joint Through Rates, per item (13) may NOT be
created to/from a destination Rail Ramp (R) point.
24. RATE
Means the price per stated unit for the service
offered under the rate.
25. REFRIGERATED CARGO
Means cargo which, because of its inherent nature,
will either deteriorate or be likely to deteriorate
unless carrier in Temperature Controlled Containers.
26. SPOT OR SPOTTING
Means the placement of an empty container or trailer
by Carrier at a storedoor location for loading by
Shipper.
27. A. STANDARD DRY CARGO CONTAINER
A Container other than an Insulated, Refrigerated,
Flatrack or Open Top Container. Rates can also be
shown as specifically applying on standard 20ft, 40
ft. 8'6", 40 ft. 9'6" high cube and 45 ft. high cube.
B. STANDARD SIZE CONTAINER
Means (1) a dry cargo container having an overall
length of 40 Feet, an overall width of eight Feet and
an overall height of eight Feet, six inches, or nine
foot, six inches or; (2) a Refrigerated Cargo
Container having an overall length of 40 Feet, or; (3)
a Flatrack Container having an overall length of 40
Feet; (4) A dry container having an overall length of
45 feet, an overall width of eight feet and an overall
height of nine feet six inches.
C. NON-STANDARD SIZE CONTAINER
Means a container with specifications other than as
described above.
28. STRAIGHT SHIPMENT
A shipment consisting of articles all of which are
described in and rated under one specific rate item in
this Tariff.
29. SHIPMENT
Except as provided in Rule 751 or Specific Items means:
A. A quantity of goods, not exceeding the capacity of
one container, tendered by one Shipper on one
shipping document at one point of origin at one
time for one Consignee at one point of destination.
B. A quantity of goods exceeding the capacity of one
container, to be loaded by Carrier, tendered by
one Shipper during one working day on one shipping
document at one Point of Origin for one Consignee
at one Point of Destination.
C. A quantity of goods exceeding the capacity of one
container, loaded by Shipper when tendered by one
Shipper on one shipping document, at one Point of
Origin for one Consignee at one Point of
Destination: provided that all containers in the
shipment must be tendered sufficiently in advance
to permit all to be loaded on board the vessel for
which the shipment is booked.
D. The term container a used in Paragraphs (A)
through (C) above, means the size container
furnished by Carrier or Shipper.
30. TON
Means 2,000 lbs.
31. VEHICLE
Means a container and chassis, or combination thereof.
32. WORKING DAY
That period of each calendar day, except Saturdays,
Sundays or Holidays, from 8:00 a.m. to 5:00 p.m.
33. "LHX" means LA-Hawaii Express (LHX) vessel service.
